Canada embraces successful business people /investors. In recent time, investment/business class of Canadian permanent immigration is increasing. Business immigrants represent about 10% of new immigrants to Canada. 
Applicant eligibility includes:

  • have legally accumulated net-worth exceeding Canadian $800,000  
  • have minimum of three years of business management experience
  • deposit Canadian $400,000 with the Government of Canada for five years. Total money is refunded back after 5 years without any interest or deposit just only Canadian $120,000 which is non-refundable 
  • fluency in English or French is not required under this program.

This entitles the applicant family to permanent residency in Canada leading to Canadian Citizenship and Passport.  Investor can live and work anywhere in Canada and no condition is attached to this visa.

Provincial Nominee Business Program

Applicant eligibility includes:

  • have legally accumulated net-worth exceeding Canadian $350,000
  • have minimum of three years of business management experience
  • make a exploratory business trip to Canada for seven days
  • deposit $ 75,000.00 which is refunded after the investment is made
  • Invest minimum of $ 150,000 in new or an existing business  
  • Moderate English language skill is required to communicate

This entitles the applicant family to permanent residency in Canada leading to Canadian Citizenship and Passport. In this case the applicant must live in the nominated province and be involved in the day to day running of the business.
If your net-worth is less than Canadian $800,000.00, you may be eligible for one of the provincial program.

More on the Provincial Business Nominee Program

Canada and its Provinces have entered into agreements that allow a person to be nominated by the Provincial Government and to be issued an Immigrant Visa without having to meet the pass mark that is required for skilled worker immigrants.

As a result, individual Provinces are responsible for issuing nomination certificates. If you are successful in convincing a Province that you have a skill or business which is in high demand for that particular Province, the Province will issue you a certificate, provided that you meet all other statutory and admissibility requirements of Citizenship and Immigration Canada and that you can become economically established. You will then be issued an Immigrant Visa for entry into Canada.

The requirements and procedures for the Provincial Nominee Programs differ from Province to Province depending upon the needs and experience.

Note: After you have been nominated by a province, you have to make a separate application to Citizenship and Immigration Canada (CIC) for permanent residence. A CIC officer will assess your application based on Canadian immigration regulations.

Provincial Nominees are not assessed on the six selection factors of the Federal Skilled Workers Program.
Processes:

  • Application is made to the provincial government
  • Applicant makes a week (7 days) visit to the province
  • A project/investment report/application is made by the Lawyer/Consultant on behalf of the applicant to the provincial government
  • Approval of the formal application and a deposit of Cad$75,000 made by the applicant
  • Issuance of permanent resident visa to applicant and family
  • The applicant has 2 years upon landing in Canada to make a Cad$ 150,000 investment on a business of his/her choice or an existing business.
  • Upon verification of the of the investment claim by the provincial government the Cad$ 75,000 will be refunded.

Entrepreneur Category


An Entrepreneur in context of Canadian immigration is a foreign national who:

1. Has minimum of two years business experience.

2. Has a legally obtained minimum net worth of $ 300,000.00. Net-worth means the fair market value of all of the assets of the entrepreneur and their spouse or common-law partner minus the fair market value of all of their liabilities.

An entrepreneur who becomes a permanent resident must meet the following conditions:

a) The entrepreneur must control a percentage of the equity of a qualifying Canadian business equal to or greater than 33 1/3 per cent.

b) The entrepreneur must provide active and ongoing management of the qualifying Canadian business; and

c) The entrepreneur must create at least one incremental full-time job equivalent for Canadian citizens or permanent residents, other than the entrepreneur and their family members.

d) The entrepreneur must meet the conditions for a period of at least one year within the period of three years after the day on which the entrepreneur becomes a permanent resident.

e) An entrepreneur who becomes a permanent resident must provide to an officer evidence of compliance with the conditions within the period of three years after the day on which the entrepreneur becomes a permanent resident.

Family Class

According to Citizenship and Immigration Canada (CIC), Canadian citizens and permanent residents living in Canada who are 18 years of age or older, may sponsor close relatives or family members who want to become permanent residents of Canada. Sponsors must promise to support the relative or family member and accompanying family members for a period of 3 to 10 years to help them settle in Canada.

Canadian citizens and permanent residents can sponsor relatives or family members from abroad if they are:

1. parents and grandparents

2. dependent children, including adopted children; children under 18 years of age whom you intend to adopt;

3. brothers, sisters, nephews, nieces or grandchildren who are orphans, under the age of 18 and not married or in a common-law relationship

4. And any other relative if you have none of the above relatives or family members, either in Canada or abroad.

Family reunification is a key objective of Canadian immigration. In addition, spouses or common-law partners who are 16 years of age or older, and have legal temporary status in Canada as visitors, students, or temporary workers (Temporary Resident Visa holders) may apply under the In-Canada Class.

Applicants and their family members are subject to medical, criminal and background checks.

Procedure

The sponsor starts the Canadian immigration process by obtaining an application from Citizenship and Immigration Canada (CIC). The type of application and submission procedure differs depending on the relationship between the sponsor and the applicant, and whether the applicant is abroad or already in Canada.

If the applicant is the sponsor's spouse, common-law partner, conjugal partner or dependent child:

Citizenship and Immigration Canada (CIC) has introduced a Joint Application Guide that is simpler and easier to use for both sponsors and applicants. The new guide is designed to promote quicker processing by streamlining the receipt of applications.

The sponsor will receive a joint application and guide, including the sponsorship and immigrant applications. It is then up to the sponsor to obtain the necessary documents and information from the applicant, whether abroad or in Canada, and submit both the sponsorship and immigrant applications and all supporting documents to the Case Processing Centre in Mississauga, Ontario.

If the applicant is outside of Canada, the Case Processing Centre will complete the sponsorship assessment and then send the immigrant portion to a visa office that serves the area where the immigrant applicant lives. The visa office assesses the immigrant's application, interviews the applicant, if necessary, and conducts medical, security and criminality checks.

An application by a spouse or common-law partner under the In-Canada Class -- including interviews, and medical, security and criminality checks -- will be assessed by a Citizenship and Immigration Canada (CIC) staff in Canada.
Other Family Class applicants

The sponsor starts the Canadian immigration process by obtaining a Sponsorship Application from Citizenship and Immigration Canada. The sponsor fills out the application and submits it to Citizenship and Immigration Canada (CIC).

Once the application has been processed, the Case Processing Centre forwards a copy of the sponsorship to the responsible visa office and sends the Application Guide for Family Class to the sponsor. The sponsor must then forward this guide to the applicant abroad.

The applicant must complete the application and submit it to the responsible visa office. The name of the office will be indicated on the correspondence included with the guide. The visa office will take no action until it receives the completed application
